Buyer: The individual or entity purchasing Goods from The Safe Havens.
Company: The Safe Havens, (company number 15961116).
Goods: The items supplied by the Company to the Buyer.
Delivery Date: The estimated date provided by the Company for delivery of the Goods.
This section establishes clear terminology, ensuring all parties understand the context of the policy.
Shipping Terms
The shipping terms apply to all shipments unless otherwise agreed in writing. Key points include:
Delivery Estimates: Delivery dates are approximate and depend on the selected option. The Company is not liable for delays beyond its control, such as carrier issues or weather, and time for delivery is not guaranteed unless specified. Early delivery may occur with reasonable notice.
Order Cut-Off: Orders must be placed by 2:00 PM the day before delivery (or 2:00 PM Friday for Sunday delivery) to qualify for listed options, unless otherwise noted.
Pricing: All prices exclude shipping, packing, insurance, and VAT unless stated. Shipping surcharges apply as detailed in the delivery options table.
Credit: Initial orders are not supplied on credit. For subsequent credit orders, payment is due within 30 days of the invoice date, aligning with stricter financial terms.
Geographic Scope: Standard rates apply to UK Mainland only. Pricing for Scottish Highlands, Islands, Northern Ireland, Republic of Ireland, and offshore postcodes (e.g., GY, HS1-9, IM, IV40-51, JE, KA27-28, KW15-17, PA20, PA41-49, PA60-78, PH42-44, PO30-41, TR21-25, ZE1-3) is POA or as listed, ensuring coverage for all UK regions.
Order Refusal: The Company reserves the right to refuse any order without providing a reason, maintaining strict control over order acceptance.
These terms ensure a structured approach to shipping, with clear expectations for both parties.
Delivery & Installation Options
The Safe Havens offers a range of delivery and installation options, with surcharges added to the base price, exclusive of VAT. The table below details the options, incorporating weight limits, geographic considerations, and multiple unit discounts:
Notes:
AM/PM and timed deliveries are subject to carrier availability.
Stair installations require clear access; complex setups (landings, turns) or heavy weights need a custom quote.
POA options require contacting The Safe Havens for pricing and feasibility.
International & Offshore Shipping
For deliveries outside UK Mainland, the Buyer is responsible for import licenses, duties, taxes, and fees, with pricing on application for offshore and international areas, ensuring strict compliance with UK regulations.
Risk and Ownership
Risk: Risk passes to the Buyer upon delivery (or when Goods are ready for collection if Buyer-arranged), a strict transfer point.
Ownership: Title remains with The Safe Havens until full payment (including shipping and VAT) is received in cleared funds.
Claims and Returns
To maintain strict standards:
Damage in Transit: Report to The Safe Havens within 48 hours of receipt.
Defects or Non-Conformity: For obvious defects or non-conformity at delivery, notify within 5 business days; for other defects, within the 12-month warranty period, balancing strict initial reporting with longer-term coverage.
Incorrect Orders: Requests to return incorrectly ordered standard items must be made within 14 days of delivery, subject to the Company's approval and a 15% restocking fee (minimum £25), plus return shipping costs. Goods must be in original packaging and resalable condition, ensuring strict return conditions.
Faulty Goods: Covered under a 12-month warranty from delivery, with repair, replacement, or refund at the Company’s discretion. No liability for wear and tear, misuse, or accidental damage, maintaining strict warranty terms.
Custom Goods: Non-returnable unless faulty at delivery, a strict policy to prevent returns of bespoke items.
Cancellations
Cancellation requests must be made in writing before dispatch, with accepted cancellations incurring costs for expenses incurred by The Safe Havens, ensuring strict control over order changes.
Force Majeure
The Company is not liable for delays due to events beyond its control (e.g., natural disasters, strikes), a standard but strict clause protecting the Company from unforeseen events.
Liability
To ensure strict liability terms:
The Company accepts no liability for injury or damage incurred during the unloading, installation, or use of its products unless caused by its employees.
The Company’s total liability to the Buyer in connection with the purchase and use of the Goods shall be limited to the purchase price of the Goods. The Company shall not be liable for any indirect or consequential losses, including but not limited to loss of profit, revenue, use, goodwill, data, business interruption, or anticipated savings.
Nothing in this policy shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law, ensuring legal compliance.
Governing Law
This policy is governed by the laws of England and Wales, with disputes under the exclusive jurisdiction of the English courts, aligning with UK legal standards.
